Terms of Service

1. Not financial advice

Momentum is an educational and entertainment service. Nothing in the Services is investment, financial, legal, or tax advice, or a recommendation to buy, sell, or hold any security. This includes chat messages, watchlists, alerts, live streams, recordings, scanner results, the simulator, journal statistics, course material, and AI assistant answers.

• Momentum is not a registered investment adviser or a broker-dealer, and it does not execute trades or manage money.
• Trading, and day trading especially, involves substantial risk, and you can lose more than you invest. Only trade with money you can afford to lose.
• Past performance does not guarantee future results. Any trades, profits, or examples shown by Momentum, its hosts, or its members may be simulated, hypothetical, or not typical. Members' results vary, and most traders lose money.
• Testimonials and member posts reflect individual experiences, not typical or expected results.
• You alone are responsible for your trading decisions. Do your own research and consider a licensed professional.

2. Eligibility and your account

• You must be at least 18 years old and able to form a binding contract.
• You must give accurate information and keep your sign-in methods (email, Whop account, devices) secure. You are responsible for everything done through your account.
• One person per account. You may not share, sell, lend, or transfer your account or membership, or let anyone else use it.
• One device at a time. The Services can be open on only one device at a time, and on a limited number of registered devices. Opening the Services on another device pauses the first one. We may limit, sign out, or suspend accounts that appear to be shared.
• We may refuse, suspend, or close accounts at our discretion, including for violating these Terms.

3. Memberships, trials, and billing

• Plans. The Services are offered through paid memberships. The price, billing period, and what each plan includes are shown at checkout. Some features (for example, the scanner and simulator, or the Bootcamp) may require a specific plan.
• Payment providers. Payments are processed by third-party providers such as Whop, Stripe, and Deposyt. Their terms also apply to your payment. We do not store your full card number.
• Free trials. A free trial is available once per person, per email address, and per payment method. Unless you cancel before the trial ends, your membership starts and you are charged automatically.
• Automatic renewal. Memberships renew automatically at the end of each billing period, at your membership's price, until you cancel. By subscribing, you authorize us and our payment provider to charge your payment method on each renewal.
• Cancellation. You can cancel at any time before your next renewal: in the Momentum app under your membership settings, or with the provider you paid through (for example, on Whop). Cancellation stops future charges. You keep access until the end of the period you already paid for.
• Refunds. Except where the law requires otherwise, all payments are final and non-refundable, including for partial periods, unused time, or features you did not use.
• Price changes. We may change the price of our plans for new members. A price change never affects your existing membership: you keep the price you joined at for as long as your membership stays active. If you cancel, or your membership ends, and you rejoin later, the price at that time applies.
• Failed payments. If a payment fails, your access may be paused until it is resolved.
• Chargebacks and payment disputes. If you dispute a charge with your bank or card company instead of contacting us, your access to all Momentum products and services will end immediately, without refund, and we may decline future memberships. Please contact business@trademomentum.org first. We are glad to help.

4. Community rules

To keep Momentum useful and safe, you agree not to:

• Harass, threaten, bully, or discriminate against anyone, or post hateful, obscene, sexually explicit, or violent content.
• Post false or defamatory statements, or impersonate Momentum, its staff, or anyone else.
• Promote or advertise other products, services, groups, chatrooms, or referral links without our permission.
• Pump, promote, or manipulate any security; spread false or misleading information about a company; or coordinate trading to move a price.
• Tell other members to buy or sell, or post "calls" presented as financial advice.
• Share, copy, record, screenshot for redistribution, resell, or publish alerts, watchlists, streams, recordings, courses, scanner data, or other member-only content outside the Services.
• Share personal information about other members.
• Post spam, malware, or illegal content, or content that infringes someone else's rights.
• Scrape, crawl, or bulk-download the Services or their data, use bots or automation, reverse engineer the Services, or try to get around security, the one-device rule, or access controls.
• Interfere with the Services or other members' use of them.

We may remove content, mute, suspend, or ban members, with or without notice, at our discretion. We may also report illegal activity to the authorities.

5. Your content

You keep ownership of the messages, images, and other content you post ("Your Content"). You give Momentum a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute Your Content to operate, promote, and improve the Services. This includes showing it to other members and in live streams and recordings. You are responsible for Your Content and confirm you have the rights to post it. We may remove Your Content at any time.

6. Live streams and recordings

Live sessions may be recorded and made available to members. Your display name, messages, and reactions may appear in a stream or its recording. Recordings are for members' personal education only and may not be downloaded, copied, or shared.

7. Market data, scanner, and simulator

• The scanner, charts, quotes, time and sales, news, and other market data come from third-party providers. They may be delayed, incomplete, or inaccurate, and they may be unavailable at times. Do not rely on them as the only basis for any trade.
• Market data is licensed for your personal, non-commercial use only. You may not redistribute it.
• The simulator uses virtual money. Simulated results do not reflect real trading, fees, slippage, or liquidity, and they do not predict real results.

8. Trading journal

The journal is a tool for recording and reviewing your own trades. You are responsible for the accuracy of what you enter or import. If you import trades, your username and statistics may appear on the member leaderboard and in challenges unless you opt out in the journal's settings.

9. Momentum AI assistant

The AI assistant answers questions about trading education and about Momentum. Its answers are generated automatically, may be wrong or incomplete, and are not financial advice. It will not give buy or sell recommendations, price targets, or predictions. Check anything important yourself.

10. Bootcamp

The 60-Day Trading Bootcamp is an educational program. Admission may require an application, and acceptance is at our discretion. Any payment plan, schedule, included room access, and bonus terms are described when you enroll. Bootcamp content is subject to these Terms, including the refund and dispute terms in Section 3.

11. Intellectual property

The Services and all of their content, including courses, videos, recordings, alerts, watchlists, scanners, software, text, graphics, logos, and the Momentum name, are owned by Momentum or its licensors and are protected by copyright, trademark, and other laws. We give you a limited, personal, non-transferable, revocable license to use the Services for your own non-commercial education while your membership is active. You may not copy, reproduce, distribute, sell, or create derivative works from them without our written permission.

12. Third-party services

The Services use or link to third-party services, such as payment providers, Whop, brokers, market data providers, and video platforms. We are not responsible for third-party services, and your use of them is governed by their own terms.

13. Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES, DATA, ALERTS, OR CONTENT WILL BE ACCURATE, COMPLETE, TIMELY, UNINTERRUPTED, OR ERROR-FREE, OR THAT USING THEM WILL RESULT IN ANY PROFIT.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MOMENTUM AND ITS OWNERS, EMPLOYEES, HOSTS, MODERATORS, AND PARTNERS WILL NOT BE LIABLE FOR ANY TRADING OR INVESTMENT LOSSES, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnity. You agree to defend, indemnify, and hold harmless Momentum and its owners, employees, hosts, and moderators from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, Your Content, your trading, or your violation of these Terms or the law.

15. Dispute resolution and arbitration

• Informal resolution first. Before filing any claim, email business@trademomentum.org with a description of the dispute, and give us 30 days to try to resolve it.
• Binding arbitration. Any dispute arising from or relating to these Terms or the Services will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. Either party may instead bring an individual claim in small claims court.
• Class action and jury waiver. Claims may be brought only individually, not as a plaintiff or class member in any class, collective, or representative action. You and Momentum each waive the right to a jury trial.
• Time limit. Any claim must be filed within one (1) year after it arises, or it is permanently barred.
• Governing law. These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-law rules, and by the Federal Arbitration Act.

16. Termination

You may stop using the Services and cancel at any time. We may suspend or end your access at any time, including for violating these Terms, non-payment, chargebacks, abusive behavior, or conduct that we believe harms Momentum or its members. Termination for these reasons is without refund. Sections 1, 3 (refunds and disputes), 5, and 11 through 17 survive termination.

17. Changes and general terms

• We may update these Terms. We will post the new version with a new "Last updated" date and, for material changes, notify you in the Services or by email. Continuing to use the Services after changes take effect means you accept them.
• These Terms and our Privacy Policy are the entire agreement between you and Momentum about the Services. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms. We may assign them in connection with a sale or transfer of our business.

Watch out for impersonators. Momentum will never ask for your password, payment details, or money in a direct message. Official messages come only from business@trademomentum.org or trademomentumbiz@gmail.com.
